A New Path Forward for EU Accountability
On 28 October 2024, the European Policy Centre (EPC) and the Rule of Law Clinic at Central European University’s Democracy Institute jointly launched the 2024 Shadow Rule of Law Report, a critical and independent analysis of the EU’s adherence to its own rule of law standards. This event brought together an audience of civil society leaders, EU officials, and academics to discuss ways forward in bolstering the EU’s internal accountability.
With insights from members of The Good Lobby Profs network, the event set the stage for a renewed approach to EU institutional accountability and transparency.
Key Findings and Recommendations
The 2024 Shadow Rule of Law Report presents a forthright assessment of internal EU mechanisms, underscoring areas in which the EU could more consistently uphold its foundational values.
- Judicial Independence: The report identifies limitations in judicial transparency, particularly in the European Court of Justice, and critiques barriers preventing individuals and organisations from seeking redress.
- Anti-Corruption and Accountability: The report highlights the fragmented anti-corruption frameworks within EU institutions and calls for harmonised guidelines across these bodies to maintain public trust.
- Democratic Integrity: It examines political influences affecting rule of law decisions within the EU, calling for a reduction in politicisation to protect decision-making integrity.
- Media Freedom and Pluralism: Although the recent European Media Freedom Act is a promising step, the report recommends robust enforcement in nations experiencing media suppression.
- Structural Reforms: The report’s authors propose an annual, independent review of EU institutions, paired with more rigorous self-assessment mechanisms. Implementing these changes could strengthen the EU’s credibility in enforcing rule of law principles both within member states and at the institutional level.
A Blueprint for Reform
Yesterday’s event was more than a report launch; it opened a policy dialogue on specific actions the EU can take to reinforce its commitment to rule of law principles. The European Commission’s Rule of Law Report has previously been criticised for lacking an internal focus, and this shadow report helps fill that gap by addressing the EU’s need for stronger internal assessment.
Strengthening EU Values from Within
As the report indicates, the EU’s ability to champion rule of law effectively depends on its commitment to holding itself accountable to the same standards expected of its member states. Moving forward, stakeholders across Europe are urged to engage with these recommendations, supporting the EU’s role as a model for democratic governance and rule of law.
